By accessing https://dominionpeakcanada.com (the “Website”), registering an account, or using our AI cryptocurrency trading bot (collectively the “Service”), you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Service.
1. Who We Are
Dominion Peak Technologies Inc. (“Dominion Peak”, “we”, “us”, “our”) is a Canadian corporation registered in Ontario with offices at 161 Bay Street, Suite 2700, Toronto, ON M5J 2S1.
2. Nature of the Service
Dominion Peak provides non-custodial, automated cryptocurrency trading software (“the Bot”). You retain full control and ownership of all funds at all times. Funds are held exclusively in your personal brokerage or exchange accounts with third-party IIROC-regulated or CIPF-protected institutions.
We do not accept deposits, hold client assets, or act as a money transmitter, broker-dealer, or investment adviser under Canadian securities laws.
3. Eligibility
You must:
- Be at least 18 years of age (19 in provinces where the age of majority is 19)
- Be a resident of Canada
- Not be a resident of Québec (due to current regulatory restrictions on crypto-derivative offerings)
- Not be a U.S. person or resident of any prohibited jurisdiction
4. Your Responsibilities
You agree to:
- Provide accurate and complete information during registration
- Keep your login credentials secure
- Connect only accounts that belong to you
- Comply with all applicable Canadian federal and provincial laws
- Pay all taxes arising from your trading activity
5. Risk Disclosure
Cryptocurrency trading involves substantial risk of loss and is not suitable for everyone. Past performance is not indicative of future results. You may lose some or all of your invested capital.
We do not guarantee profits or protection against losses. You are solely responsible for evaluating the merits and risks of using the Bot.
6. Fees
Subscription fees are outlined on the pricing page and are non-refundable except during the 7-day money-back guarantee period for new users. We may change fees with 30 days’ notice.
7. Prohibited Conduct
You may not:
- Use the Bot for market manipulation, wash trading, or any illegal activity
- Reverse engineer, decompile, or attempt to extract the source code
- Share your account or allow third-party access
- Use VPNs or other tools to misrepresent your location
8. Intellectual Property
The Bot, website, branding, and all related materials are owned by or licensed to Dominion Peak. You are granted a limited, non-transferable license to use the Service for personal trading only.
9. Termination
We may suspend or terminate your access immediately if we believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Service or other users.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMINION PEAK, ITS OFFICERS, DIRECTORS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability shall not exceed the fees you paid us in the 3 months preceding any claim.
11. Indemnification
You agree to indemnify and hold Dominion Peak harmless from any claims, losses, or damages arising from your use of the Service or violation of these Terms.
12. Governing Law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable therein. Any dispute shall be resolved exclusively in the courts of Toronto, Ontario.
13. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
